Welcome to Borrow Money: PayDay Loans Idx. These Terms and Conditions (“Terms”) represent a legally binding agreement between you (“User,” “you,” or “your”) and Payday Loans Index LLC (also referred to as "we," "us," or "our"). By accessing or using the Payday Loans Index LLC mobile app (“App”) and any related services, you agree to abide by these Terms. If you do not agree with these Terms, you must immediately stop using the App.

1. Our Services

Borrow Money: PayDay Loans Idx provides a platform that connects users with independent third-party lenders (“Lenders”). We do not provide loans, make credit decisions, or act as a lender. Our role is to help you submit loan requests and display loan offers from Lenders based on the information you provide.

We do not guarantee loan approval, loan amounts, or specific terms such as interest rates or repayment periods. Any loan agreement you enter into is strictly between you and the Lender.

1.1 Loan Terms

The Annual Percentage Rate (APR) for loans available through the App ranges from 4.99% to 35.00%. The final APR and loan terms will depend on your credit profile, income, and other factors determined by the Lender.

1.2 Representative Example

For example, if you borrow $200 for 12 months at an APR of 11.5%, your monthly payment would be approximately $17.78. Over 12 months, your total repayment would be approximately $213.38. The total interest paid over the life of the loan would be around $13.38.

1.3 Repayment Terms

Repayment periods offered by Lenders typically range from 90 days to 24 months. Specific repayment schedules and terms will be provided by the individual Lender.

2. Eligibility

To use the App, you must be at least 18 years of age and a resident of the United States. By using the App, you confirm that you meet these requirements and have the legal capacity to enter into a binding agreement.

3. Account Registration and Security

Certain features of the App may require account registration. By creating an account, you agree to provide accurate, current, and complete information and to update your details as needed. You are responsible for maintaining the security of your account credentials and for all activities conducted under your account.

We reserve the right to suspend or terminate your account if we suspect fraudulent, abusive, or unlawful activity.

4. Loan Offers and Third-Party Lenders

Borrow Money: PayDay Loans Idx is not a party to any loan agreement between you and a Lender. We do not endorse or guarantee the products or services of any Lender. It is your responsibility to carefully review all terms and conditions of any loan offer before accepting it.

5. No Guarantee of Loan Approval

Submitting a loan request via the App does not guarantee that you will receive a loan offer or be approved for a loan. Loan approval is determined solely by the Lender based on their criteria.

6. Fees and Charges

Borrow Money: PayDay Loans Idx does not charge any fees for using the App or submitting a loan request. However, Lenders may impose fees, including but not limited to origination fees, late payment fees, non-sufficient funds fees, and interest charges. You are solely responsible for reviewing and agreeing to any fees associated with a loan offer.

7. User Conduct

By using the App, you agree not to engage in any activity that:

  • Violates any applicable law or regulation.
  • Provides false or misleading information.
  • Attempts to interfere with or disrupt the operation of the App.
  • Accesses data not intended for you.
  • Attempts to breach the security of the App.

8. Privacy and Data Collection

Your use of the App is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the practices described in our Privacy Policy.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties, express or implied. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will operate uninterrupted, be error-free, or be completely secure.

10. Limitation of Liability

To the fullest extent permitted by law, Borrow Money: PayDay Loans Idx shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App or your interactions with Lenders.

11. Indemnification

You agree to indemnify and hold harmless Borrow Money: PayDay Loans Idx, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, or expenses arising from your violation of these Terms or your use of the App.

12. Changes to These Terms

We may update or revise these Terms at any time. Any changes will become effective upon posting within the App. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in Wyoming, unless prohibited by law.
